ATTENDED UNLIMITED ACCESS AGREEMENT

I agree that I will not use CYOU Internet Service as a full time connection or remain connected by electronic means such as e-mail or network telephone, or monitoring Chat rooms while I am NOT at the computer. I understand that my access is "attended nonbusiness) unlimited attended access" which means that I may use the CYOU Connection as long as I am physically sitting at my computer. Usage beyond 250 hours per month (that is an average of 8.33 hours per day) is considered a full time connection and is subject to the dedicated line price of $99 per month with a $75 setup fee or you may .50 per hour over the 250 hour limit. In the event that you need to use more than 8 1/3 hours in one day, you may request in advance through e-mail by sending your request to info@cyou.com and letting us know when you will need more than 8 1/3 hours in one day and how long you will need.  CYOU reserves the right to terminate any accounts that abuse the "attended unlimited access" agreement and should termination be implemented NO money will be refunded.

What happens if you go over 250 hours:
In the event that you go over the 250 hour cap on the attended plan the following procedure will be followed:
If you have paid for the coming month or if you have a credit on your account for being on the 3, 6, or 12 month plan, you will be e-mailed and given 5 days  from the date the e-mail is sent to cover the amount due.  In the event that you do not pay  the per hour charge for going over the 250 hour cap within 5 days , your account is reviewed and the amount paid for the coming month or amount of credit you have for any prepaid plan  is used to pay the overage amount due.  If this causes your account to have a negative ballance, your account will be disconnected until the negative ballance is corrected, if your account falls below the amount needed for limited access, your account will be disconnected until enough is paid to fill the minimum plan.  For example.  You have paid $18 for one month but in reviewing your hours online it is found that your went over 12 hours for the previous month.  You will be notified by e-mail that $6 is due within 3 days of CYOU sending the e-mail.   Should you refuse to pay, CYOU will take the amount you paid for the coming month (in this case $18) and subtract the amount due for the previous month ($6) leaving you with a credit of $12.  Since $12 is not enough to keep you in the unlimited attended plan, your plan will be reduced to the limited plan (10 for 15 hours). Since you have a $12 credit, this means that you would be allowed to use 17 hours and then your account would be terminated until you paid for another month.  If your account is terminated, you will not be allowed to pay the difference between $12 and $18 to bump your account back up to attended unlimited.  You will have to pay for a full month of attended unlimited plus a $5 reconnect fee.

What happens if you pay $18 after the 3rd of the month?
If you are on the monthly plan, the amount due each month is $20.  That is our monthly price for Internet Service.   However, because our phone bill is due a certain time each month, we offer a 10% discount to our monthly customers that pay by the 3rd of each month.  This means if you pay your monthly internet bill by the 3rd, you save $2 and only have to pay $18.   This payment must either be postmarked by the 3rd (this means that you must have dropped your payment in the mail so that upon collection by the Post Office it has a postmark of the 3rd-if the 3rd falls on a holiday or weekend you must mail your payment sooner to get the discount), or it must reach our affiliate CSales.Net by 6pm on the 3rd.   CSales.Net closes at 6pm M-F and at 2pm on Saturdays.  They are closed on Sundays.  Because our 10% discount is date & time related, we go by CSales.Net each night at 6pm-even on Saturday and Sunday.  As long as your payment is there by 6pm on the 3rd of each month, you get the 10% discount.  If you pay after the 3rd at 6pm you must pay the full $20.  CSales.Net posts a note on the door by the drop slot in the door that explains how much you must pay.  In the event that you attempt to take the 10% discount after the 3rd, we will e-mail you that you were short $2 and you will have 5 days to pay the additional $2.  If the additional $2 is not paid within the 5 days, your account is automatically reduced to the limited access plan ($10 for 15 hours plus $1 per hour for each hour over 15 or fraction thereof).  This means that after 23 hours of usage, your account will be terminated and you will not be able at that time to come pay $2 and switch it back to the attended access plan.  In fact, to reactivate, you will have to pay a $5 reconnection fee plus $20 for the attended access plan.

What happens if your account is terminated for nonpayment?
In the event that your account is terminated for nonpayment (ie. payment does not reach us by the 9th of any month by 6pm), you must pay a $5 reconnect fee to reactivate your account.  Payments are accepted at our affiliate "CSales.Net".  CSales.Net is open M-F from 10am til 6pm and Saturday from 10am til 2pm.  In the event CSales.Net is closed, they do have a drop slot in their door for payments.   Because our payment schedule is date and time related, someone from CYOU Internet Service stops by CSales.Net every day after 6pm to pick up payments-even on Saturday and Sunday.  If you pay after the 9th, you must include the $5 reconnect fee in with your payment.  Csales.Net always posts a note on the door right beside the drop slot telling you how much to pay.  In the event that you pay after the 9th at 6pm, and you only pay $20(you do not include the reconnect fee), this is what happens:  You will be sent an e-mail notifying you of the shortage and given 5 days to correct this shortage.  If the $5 is not submitted within the 5 days, the reconnect fee is subtracted from the $20 leaving $15 to be applied to your internet service.  Because $15 is not enough for the attended access plan, your plan is reduced to the limited plan ($10 for 15 hours plus $1 per hour for each hour over 15 or fraction thereof). This means that after 20 hours of usage, your account will be terminated and you will not be able at that time to come pay $5 and switch it back to the attended access plan.  In fact, to reactivate, you will have to pay an additional $5 reconnect fee plus $20 for the attended access plan.
